{"id":1072,"date":"2021-08-18T14:15:30","date_gmt":"2021-08-18T14:15:30","guid":{"rendered":"https:\/\/www.think-green.ro\/?p=1072"},"modified":"2021-08-18T14:26:55","modified_gmt":"2021-08-18T14:26:55","slug":"ordin-nr-756-din-3-noiembrie-1997-pentru-aprobarea-reglementarii-privind-evaluarea-poluarii-mediului","status":"publish","type":"post","link":"https:\/\/www.think-green.ro\/en\/ordin-nr-756-din-3-noiembrie-1997-pentru-aprobarea-reglementarii-privind-evaluarea-poluarii-mediului\/","title":{"rendered":"Ordin nr. 756 din 3 noiembrie 1997 pentru aprobarea Reglement\u0103rii privind evaluarea polu\u0103rii mediului"},"content":{"rendered":"<p><strong>Ministrul apelor, p\u0103durilor \u015fi protec\u0163iei mediului<br \/>\n<\/strong><br \/>\n\u00cen temeiul prevederilor art. 9, art. 10 alin. 4, art. 14 \u015fi art. 64 lit. d) din Legea protec\u0163iei mediului nr. 137\/1995,<br \/>\nOrdinului nr. 125\/1996 sec\u0163iunea 5 pct. 5.4., 5.5. \u015fi 5.6. \u015fi sec\u0163iunea 8 pct. 8.1. \u015fi 8.2. al ministrului apelor, p\u0103durilor \u015fi protec\u0163iei mediului, care a aprobat Procedura de reglementare a activit\u0103\u0163ilor economico-sociale cu impact asupra mediului,<br \/>\nHot\u0103r\u00e2rii Guvernului nr. 568\/1997 privind organizarea \u015fi func\u0163ionarea Ministerului Apelor, P\u0103durilor \u015fi Protec\u0163iei Mediului, cu modific\u0103rile ulterioare,<br \/>\nemite urm\u0103torul ordin:<br \/>\n1.Se aprob\u0103 Reglementarea privind evaluarea polu\u0103rii mediului, prev\u0103zut\u0103 \u00een anexa care face parte integrant\u0103 din prezentul ordin.<br \/>\n2.Departamentul protec\u0163iei mediului prin Direc\u0163ia strategii \u015fi reglement\u0103ri pentru protec\u0163ia mediului r\u0103spunde de aplicarea prevederilor prezentului ordin \u015fi de instruirea periodic\u0103 \u00een mod unitar a personalului din cadrul unit\u0103\u0163ilor teritoriale, care \u00ee\u015fi desf\u0103\u015foar\u0103 activitatea \u00een domeniul emiterii actelor de reglementare.<br \/>\n3.Prezentul ordin intr\u0103 \u00een vigoare la data public\u0103rii lui \u00een Monitorul Oficial al Rom\u00e2niei.<\/p>\n<p>REGLEMENT\u0102RI din 3 noiembrie 1997 privind evaluarea polu\u0103rii mediului<br \/>\nCAPITOLUL I: Dispozi\u0163ii generale<\/p>\n<p><strong>Art. 1<\/strong><br \/>\nPrezenta reglementare stabile\u015fte procedurile \u015fi normele tehnice privind identificarea prejudiciilor aduse mediului, \u00een scopul determin\u0103rii responsabilit\u0103\u0163ilor pentru remedierea acestora \u015fi se emite \u00een baza prevederilor art. 36, 42 \u015fi 48 din Legea protec\u0163iei mediului nr. 137\/1995, precum \u015fi a prevederilor articolului 15 alin. (5) din Legea apelor nr. 107\/1996.<br \/>\nPrevederile prezentei reglement\u0103ri nu se refer\u0103 la contamin\u0103rile cu microorganisme \u015fi\/sau substan\u0163e radioactive care sunt supuse altor prevederi legale.<\/p>\n<p><strong>Art. 2<\/strong><br \/>\n\u00cen \u00een\u0163elesul prezentului ordin, se vor utiliza defini\u0163iile urm\u0103toarelor no\u0163iuni:<br \/>\n\u2022 Aer ambiental \u2013 aer la care sunt expuse persoanele, plantele, animalele \u015fi bunurile materiale, \u00een spa\u0163ii deschise din afara perimetrului uzinal.<br \/>\n\u2022 Autoritate competent\u0103 \u2013 autoritate de mediu, de ape, s\u0103n\u0103tate sau alt\u0103 autoritate \u00eemputernicit\u0103 potrivit competen\u0163elor legale s\u0103 execute controlul reglement\u0103rilor \u00een vigoare privind protec\u0163ia aerului, apelor, solului \u015fi ecosistemelor acvatice sau terestre.<br \/>\n\u2022 Emisie de poluan\u0163i\/emisie \u2013 desc\u0103rcare \u00een atmosfer\u0103 a poluan\u0163ilor proveni\u0163i din surse sta\u0163ionare sau mobile.<br \/>\n\u2022 Evacuare de ape uzate\/evacuare \u2013 desc\u0103rcare direct\u0103 sau indirect\u0103 \u00een receptori acvatici a apelor uzate con\u0163in\u00e2nd poluan\u0163i sau reziduuri care altereaz\u0103 caracteristicile fizice, chimice \u015fi bacteriologice ini\u0163iale ale apei utilizate, precum \u015fi a apelor de ploaie ce se scurg de pe terenuri contaminate.<br \/>\n\u2022 Evaluare a riscului \u2013 analiza probabilit\u0103\u0163ii \u015fi gravit\u0103\u0163ii principalelor componente ale unui impact asupra mediului.<br \/>\n\u2022 Folosin\u0163\u0103 sensibil\u0103 \u015fi mai pu\u0163in sensibil\u0103 \u2013 tipuri de folosin\u0163e ale terenurilor, care implic\u0103 o anumit\u0103 calitate a solurilor, caracterizat\u0103 printr-un nivel maxim acceptat al poluan\u0163ilor.<br \/>\n\u2022 Impact de mediu \u2013 modificarea negativ\u0103 considerabil\u0103 a caracteristicilor fizice, chimice \u015fi structurale ale elementelor \u015fi factorilor de mediu naturali; diminuarea diversit\u0103\u0163ii biologice; modificarea negativ\u0103 considerabil\u0103 a productivit\u0103\u0163ii ecosistemelor naturale \u015fi antropizate; deteriorarea echilibrului ecologic, reducerea considerabil\u0103 a calit\u0103\u0163ii vie\u0163ii sau deteriorarea structurilor antropizate, cauzat\u0103, \u00een principal, de poluarea apelor, a aerului \u015fi a solului; supraexploatarea resurselor naturale, gestionarea, folosirea sau planificarea teritorial\u0103 necorespunz\u0103toare a acestora; un astfel de impact poate fi identificat \u00een prezent sau poate avea o probabilitate de manifestare \u00een viitor, considerat\u0103 inacceptabil\u0103 de c\u0103tre autorit\u0103\u0163ile competente.<br \/>\n\u2022 Obiective de remediere \u2013 concentra\u0163ii de poluan\u0163i, stabilite de autoritatea competent\u0103, privind reducerea polu\u0103rii solului, \u015fi care vor reprezenta concentra\u0163iile maxime ale poluan\u0163ilor din sol dup\u0103 opera\u0163iunile de depoluare. Aceste valori se vor situa sub nivelurile de alert\u0103 sau interven\u0163ie ale agen\u0163ilor contaminan\u0163i, \u00een func\u0163ie de rezultatele \u015fi recomand\u0103rile studiului de evaluare a riscului.<br \/>\n\u2022 Poluare poten\u0163ial semnificativ\u0103 \u2013 concentra\u0163ii de poluan\u0163i \u00een mediu, ce dep\u0103\u015fesc pragurile de alert\u0103 prev\u0103zute \u00een reglement\u0103rile privind evaluarea polu\u0103rii mediului. Aceste valori definesc nivelul polu\u0103rii la care autorit\u0103\u0163ile competente consider\u0103 c\u0103 un amplasament poate avea un impact asupra mediului \u015fi stabilesc necesitatea unor studii suplimentare \u015fi a m\u0103surilor de reducere a concentra\u0163iilor de poluan\u0163i \u00een emisii\/evacu\u0103ri.<br \/>\n\u2022 Poluare semnificativ\u0103 \u2013 concentra\u0163ii de poluan\u0163i \u00een mediu, ce dep\u0103\u015fesc pragurile de interven\u0163ie prev\u0103zute \u00een reglement\u0103rile privind evaluarea polu\u0103rii mediului.<br \/>\n\u2022 Prag de alert\u0103 \u2013 concentra\u0163ii de poluan\u0163i \u00een aer, ap\u0103, sol sau \u00een emisii\/evacu\u0103ri, care au rolul de a avertiza autorit\u0103\u0163ile competente asupra unui impact poten\u0163ial asupra mediului \u015fi care determin\u0103 declan\u015farea unei monitoriz\u0103ri suplimentare \u015fi\/sau reducerea concentra\u0163iilor de poluan\u0163i din emisii\/evacu\u0103ri.<br \/>\n\u2022 Prag de interven\u0163ie \u2013 concentra\u0163ii de poluan\u0163i \u00een aer, ap\u0103, sol sau \u00een emisii\/evacu\u0103ri, la care autorit\u0103\u0163ile competente vor dispune executarea studiilor de evaluare a riscului \u015fi reducerea concentra\u0163iilor de poluan\u0163i din emisii\/evacu\u0103ri.<br \/>\n\u2022 Prob\u0103 de referin\u0163\u0103 \u2013 prob\u0103 material\u0103 produs\u0103 de un institut specializat, ce poate fi utilizat\u0103 pentru a identifica precizia \u015fi acurate\u0163ea tehnicilor de analiz\u0103 chimic\u0103 a solurilor.<br \/>\n\u2022 Preceptori acvatici \u2013 ape de suprafa\u0163\u0103 interioare, de frontier\u0103 sau costiere, precum \u015fi ape subterane, \u00een care sunt evacuate ape uzate, except\u00e2nd zonele de influen\u0163\u0103 direct\u0103 sau de amestec ale acestor evacu\u0103ri.<br \/>\nCAPITOLUL II: Praguri de alert\u0103 \u015fi praguri de interven\u0163ie<\/p>\n<p><strong>Art. 3<\/strong><br \/>\nPrezenta reglementare define\u015fte semnifica\u0163ia \u015fi stabile\u015fte dispozi\u0163iile referitoare la pragurile de alert\u0103 \u015fi la pragurile de interven\u0163ie pentru poluan\u0163ii din: aer, ap\u0103 \u015fi sol.<\/p>\n<p><strong>Art. 4<\/strong><br \/>\nDispozi\u0163iile referitoare la pragurile de alert\u0103 sunt urm\u0103toarele: a) pragurile de alert\u0103 avertizeaz\u0103 autorit\u0103\u0163ile competente asupra existen\u0163ei, \u00eentr-o anumit\u0103 situa\u0163ie, a unei polu\u0103ri poten\u0163iale \u00een aer, ap\u0103 sau sol; b) c\u00e2nd concentra\u0163ia unuia sau mai multor poluan\u0163i dep\u0103\u015fe\u015fte un prag de alert\u0103, autorit\u0103\u0163ile competente pot dispune, dac\u0103 se consider\u0103 necesar, o monitorizare suplimentar\u0103 asigurat\u0103 de c\u0103tre titularii activit\u0103\u0163ilor poten\u0163ial responsabile de poluare, fie prin sisteme proprii, fie prin unit\u0103\u0163i specializate. \u00cen acela\u015fi timp, autorit\u0103\u0163ile competente vor solicita \u015fi vor urm\u0103ri introducerea unor m\u0103suri de reducere a concentra\u0163iilor de poluan\u0163i din emisii\/evacu\u0103ri.<\/p>\n<p><strong>Art. 5<\/strong><br \/>\nPragurile de interven\u0163ie sunt pragurile de poluare la care autorit\u0103\u0163ile competente:<br \/>\na)apreciaz\u0103 oportunitatea \u015fi solicit\u0103, dac\u0103 este necesar, executarea studiilor de evaluare a riscului;<br \/>\nb)investigheaz\u0103 consecin\u0163ele polu\u0103rii asupra mediului;<br \/>\nc)impun reducerea polu\u0103rii, astfel \u00eenc\u00e2t concentra\u0163iile de poluan\u0163i \u00een emisii\/evacu\u0103ri s\u0103 scad\u0103 la valorile prev\u0103zute de reglement\u0103rile \u00een vigoare.<br \/>\nCAPITOLUL III: Reglement\u0103ri privind poluarea solurilor<\/p>\n<p><strong>Art. 6<\/strong><br \/>\nPragurile de alert\u0103 \u015fi pragurile de interven\u0163ie pentru concentra\u0163iile agen\u0163ilor poluan\u0163i \u00een soluri sunt cuprinse \u00een anexa la prezentele reglement\u0103ri. Aceste valori vor \u00eenlocui toate celelalte norme utilizate anterior \u00een Rom\u00e2nia, referitoare la poluarea solurilor.<\/p>\n<p><strong>Art. 7<\/strong><br \/>\nImportan\u0163a polu\u0103rii solurilor cu substan\u0163e chimice \u015fi al\u0163i agen\u0163i poluan\u0163i care nu sunt inclu\u015fi \u00een anexa la prezentele reglement\u0103ri va fi apreciat\u0103 de c\u0103tre autorit\u0103\u0163ile competente pe baza unor studii efectuate de unit\u0103\u0163i specializate.<\/p>\n<p><strong>Art. 8<\/strong><br \/>\nPrezentele reglement\u0103ri privind poluarea solurilor se refer\u0103 at\u00e2t la folosin\u0163a sensibil\u0103, c\u00e2t \u015fi la cea mai pu\u0163in sensibil\u0103 a terenurilor, identificate dup\u0103 cum urmeaz\u0103:<br \/>\na)folosin\u0163a sensibil\u0103 a terenurilor este reprezentat\u0103 de utilizarea acestora pentru zone reziden\u0163iale \u015fi de agrement, \u00een scopuri agricole, ca arii protejate sau zone sanitare cu regim de restric\u0163ii, precum \u015fi suprafe\u0163ele de terenuri prev\u0103zute pentru astfel de utiliz\u0103ri \u00een viitor;<br \/>\nb)folosin\u0163a mai pu\u0163in sensibil\u0103 a terenurilor include toate utiliz\u0103rile industriale \u015fi comerciale existente, precum \u015fi suprafe\u0163ele de terenuri prev\u0103zute pentru astfel de utiliz\u0103ri \u00een viitor;<br \/>\nc)\u00een cazul \u00een care exist\u0103 incertitudini asupra \u00eencadr\u0103rii unei folosin\u0163e de teren, se vor considera concentra\u0163iile pragurilor de alert\u0103 \u015fi de interven\u0163ie pentru folosin\u0163ele sensibile ale terenurilor.<\/p>\n<p><strong>Art. 9<\/strong><br \/>\nRelevan\u0163a pragurilor de alert\u0103 \u015fi de interven\u0163ie va determina urm\u0103toarele m\u0103suri:<br \/>\na)\u00een situa\u0163iile \u00een care concentra\u0163iile de poluan\u0163i \u00een sol se situeaz\u0103 sub valorile de alert\u0103 pentru folosin\u0163a sensibil\u0103 a terenurilor, autorit\u0103\u0163ile competente nu vor stabili m\u0103suri speciale;<br \/>\nb)c\u00e2nd concentra\u0163iile unuia sau mai multor poluan\u0163i din soluri dep\u0103\u015fesc pragurile de alert\u0103, dar se situeaz\u0103 sub pragurile de interven\u0163ie pentru folosin\u0163a corespunz\u0103toare a terenului, se consider\u0103 c\u0103 exist\u0103 impact poten\u0163ial asupra solului. \u00cen aceste situa\u0163ii, autorit\u0103\u0163ile competente vor dispune m\u0103suri de prevenire a polu\u0103rii \u00een continuare a solului \u015fi de monitorizare suplimentar\u0103 a surselor poten\u0163iale de poluare;<br \/>\nc)c\u00e2nd concentra\u0163iile unuia sau mai multor poluan\u0163i din soluri dep\u0103\u015fesc pragurile de interven\u0163ie pentru folosin\u0163a existent\u0103 a terenului, se consider\u0103 c\u0103 exist\u0103 impact asupra solului. \u00cen aceste situa\u0163ii, utilizarea zonei afectate pentru folosin\u0163e sensibile nu este permis\u0103 \u015fi vor fi realizate prevederile art. 10. Dezvoltarea acestor zone pentru folosin\u0163e mai pu\u0163in sensibile ale terenurilor poate fi permis\u0103, dac\u0103 concentra\u0163iile acestor poluan\u0163i nu dep\u0103\u015fesc valorile de interven\u0163ie ale folosin\u0163ei mai pu\u0163in sensibile a terenurilor. Dac\u0103 sunt dep\u0103\u015fite valorile de interven\u0163ie pentru categoria de folosin\u0163\u0103 mai pu\u0163in sensibil\u0103 a terenurilor, nu se va permite nici o folosin\u0163\u0103 a terenurilor \u015fi vor fi aplicate prevederile art. 10 \u015fi, dup\u0103 caz, ale art. 11;<br \/>\nd)pentru situa\u0163ia \u00een care este necesar pentru o anumit\u0103 utilizare ca un teren de folosin\u0163\u0103 mai pu\u0163in sensibil\u0103 s\u0103 treac\u0103 \u00een categoria de folosin\u0163\u0103 sensibil\u0103, trebuie satisf\u0103cute cerin\u0163e speciale. \u00cen astfel de situa\u0163ii, utilizarea terenurilor pentru folosin\u0163e sensibile este posibil\u0103, numai dac\u0103 concentra\u0163iile de poluan\u0163i din sol se \u00eencadreaz\u0103 sub nivelul de alert\u0103 al folosin\u0163ei sensibile a terenurilor \u015fi dac\u0103 sunt satisf\u0103cute prevederile art. 10 \u015fi, dup\u0103 caz, ale art. 11 ;<br \/>\ne)c\u00e2nd pragurile de interven\u0163ie sunt dep\u0103\u015fite la unul sau mai mul\u0163i poluan\u0163i din sol pentru terenuri cu folosin\u0163\u0103 sensibil\u0103 sau mai pu\u0163in sensibil\u0103, autorit\u0103\u0163ile competente vor dispune executarea unui studiu de evaluare a riscului. Obliga\u0163ia execut\u0103rii studiului de evaluare a riscului va fi a titularilor de activit\u0103\u0163i desf\u0103\u015furate pe zona de teren afectat\u0103, cu excep\u0163ia cazurilor \u00een care s-au identificat al\u0163i responsabili pentru poluarea \u00eenregistrat\u0103;<br \/>\nf)atunci c\u00e2nd sunt implica\u0163i mai mul\u0163i titulari de activit\u0103\u0163i desf\u0103\u015furate pe un teren afectat de poluare, autorit\u0103\u0163ile competente vor solicita un singur studiu de evaluare a riscului pentru zona \u00een cauz\u0103, iar costul acestuia va fi \u00eemp\u0103r\u0163it \u00eentre titulari, corespunz\u0103tor ariei geografice de\u0163inute \u00een zona afectat\u0103. \u00cen anumite situa\u0163ii, c\u00e2nd autorit\u0103\u0163ile competente pot identifica un titular considerat ca posibil r\u0103spunz\u0103tor de poluare, acestuia i se poate solicita s\u0103 suporte costul total al studiului de evaluare a riscului.<\/p>\n<p><strong>Art. 10<\/strong><br \/>\nPentru stabilirea obiectivelor de remediere pe baza interpret\u0103rii studiilor de evaluare a riscului, autorit\u0103\u0163ile competente trebuie s\u0103 decid\u0103 dac\u0103:<br \/>\na)pot fi dezvoltate \u00een viitor obiective care implic\u0103 utilizarea terenurilor pentru folosin\u0163a sensibil\u0103 sau mai pu\u0163in sensibil\u0103 a terenurilor;<br \/>\nb)terenul poate r\u0103m\u00e2ne \u00een continuare \u00een folosin\u0163a curent\u0103, dar folosin\u0163a nu mai poate fi extins\u0103;<br \/>\nc)trebuie luate m\u0103suri de remediere.<\/p>\n<p><strong>Art. 11<\/strong><br \/>\n\u00cen situa\u0163iile c\u00e2nd sunt necesare lucr\u0103ri de remediere, autorit\u0103\u0163ile competente vor stabili obiectivele de remediere, lu\u00e2nd \u00een considerare urm\u0103toarele:<br \/>\na)aceste obiective de remediere, reprezent\u00e2nd concentra\u0163iile finale de poluan\u0163i din soluri dup\u0103 realizarea lucr\u0103rilor de depoluare, se vor situa fie sub pragurile de alert\u0103 fie sub pragurile de interven\u0163ie. Autorit\u0103\u0163ile competente vor stabili, pentru fiecare caz \u00een parte, dac\u0103 obiectivele de remediere vor fi valorile de alert\u0103 sau valorile de interven\u0163ie, pe baza rezultatelor studiului de evaluare a riscului \u015fi a estim\u0103rii costurilor \u015fi beneficiilor remedierii;<br \/>\nb)c\u00e2nd se execut\u0103 activit\u0103\u0163i de remediere, titularul va r\u0103spunde de lucr\u0103rile implicate \u015fi va prezenta autorit\u0103\u0163ilor competente dovada c\u0103 prin lucr\u0103rile de remediere s-au atins concentra\u0163iile de poluan\u0163i stabilite ca obiective de remediere de c\u0103tre autoritatea competent\u0103.<\/p>\n<p><strong>Art. 12<\/strong><br \/>\nPrelevarea \u015fi analizarea probelor de sol se va face \u00een conformitate cu urm\u0103toarele prevederi:<br \/>\na)prelevarea de probe de soluri \u00een scopul estim\u0103rii nivelului de poluare se va face \u00een conformitate cu prevederile Ordinului ministrului apelor, p\u0103durilor \u015fi protec\u0163iei mediului nr. 184\/1997 privind Procedura de realizare a bilan\u0163urilor de mediu;<br \/>\nb)laboratoarele care execut\u0103 analize de poluan\u0163i din soluri vor utiliza probe de referin\u0163\u0103 pentru a confirma acurate\u0163ea \u015fi precizia tehnicilor analitice folosite. Aceste probe de referin\u0163\u0103 trebuie analizate \u00eempreun\u0103 cu probe prelevate din fiecare zon\u0103 a terenului \u015fi toate probele vor fi analizate cu metodologia adecvat\u0103, conform standardelor \u00een vigoare;<br \/>\nc)\u00een situa\u0163iile \u00een care pentru anumi\u0163i poluan\u0163i nu exist\u0103 metode standard de analiz\u0103, se vor folosi metodele analitice agreate la nivel interna\u0163ional, care vor fi difuzate autorit\u0103\u0163ilor competente de c\u0103tre autoritatea central\u0103 pentru protec\u0163ia mediului;<br \/>\nd)r\u0103spunderea pentru acurate\u0163ea \u015fi precizia rezultatelor analizelor privind concentra\u0163iile agen\u0163ilor poluan\u0163i \u00een soluri va reveni p\u0103r\u0163ii care execut\u0103 prelevarea probelor \u015fi laboratoarelor care execut\u0103 analizele.<br \/>\nCAPITOLUL IV: Reglement\u0103ri privind evaluarea polu\u0103rii aerului<\/p>\n<p><strong>Art. 13<\/strong><br \/>\nPragurile de alert\u0103 \u015fi de interven\u0163ie privind poluarea atmosferei se definesc \u00een felul urm\u0103tor:<br \/>\na)dep\u0103\u015firea concentra\u0163iilor maxime admise de poluan\u0163i, \u00eenscrise \u00een reglement\u0103rile legale, se consider\u0103 praguri de interven\u0163ie pentru poluarea atmosferic\u0103;<br \/>\nb)pragurile de alert\u0103 pentru concentra\u0163iile de poluan\u0163i \u00een emisiile atmosferice \u015fi \u00een aerul ambiental sunt stabilite la 70% din pragurile de interven\u0163ie ale acelora\u015fi poluan\u0163i, lu\u00e2nd \u00een considerare perioada de timp relevant\u0103 \u00een care trebuie s\u0103 se m\u0103soare aceste concentra\u0163ii.<\/p>\n<p><strong>Art. 14<\/strong><br \/>\nImportan\u0163a existen\u0163ei \u00een emisiile atmosferice \u015fi \u00een aerul ambiental a unor substan\u0163e chimice \u015fi a altor agen\u0163i care nu sunt \u00eenscri\u015fi \u00een reglement\u0103rile legale existente va fi estimat\u0103 prin studii efectuate de institu\u0163ii specializate, iar costul acestora va fi suportat de c\u0103tre unitatea care produce emisiile con\u0163in\u00e2nd aceste substan\u0163e.<\/p>\n<p><strong>Art. 15<\/strong><br \/>\nRelevan\u0163a pragurilor de alert\u0103 \u015fi de interven\u0163ie \u00een procesul de interpretare \u015fi decizie al autorit\u0103\u0163ii competente determin\u0103 urm\u0103toarele situa\u0163ii:<br \/>\na)c\u00e2nd concentra\u0163iile de poluan\u0163i \u00een emisiile atmosferice sau \u00een aerul ambiental se situeaz\u0103 sub pragurile de alert\u0103, nu este necesar\u0103 stabilirea unor m\u0103suri speciale de c\u0103tre autoritatea competent\u0103;<br \/>\nb)c\u00e2nd concentra\u0163iile unuia sau mai multor poluan\u0163i dep\u0103\u015fesc pragurile de alert\u0103, dar se situeaz\u0103 sub nivelurile de interven\u0163ie, pentru emisiile atmosferice sau pentru aerul ambiental, se consider\u0103 c\u0103 exist\u0103 impact poten\u0163ial asupra aerului. \u00cen aceste situa\u0163ii, autorit\u0103\u0163ile competente vor cere reducerea concentra\u0163iilor de poluan\u0163i \u00een emisii \u015fi monitorizarea suplimentar\u0103 a surselor identificate sau poten\u0163iale de poluare;<br \/>\nc)c\u00e2nd concentra\u0163iile unuia sau mai multor poluan\u0163i din emisiile atmosferice sau din aerul ambiental dep\u0103\u015fesc pragurile de interven\u0163ie, se consider\u0103 c\u0103 exist\u0103 impact asupra aerului. C\u00e2nd aceast\u0103 situa\u0163ie se datoreaz\u0103 emisiilor atmosferice provenind de la o singur\u0103 surs\u0103, autorit\u0103\u0163ile competente vor dispune reducerea concentra\u0163iilor de poluan\u0163i, astfel \u00eenc\u00e2t s\u0103 nu se dep\u0103\u015feasc\u0103 nivelurile de interven\u0163ie. C\u00e2nd emisiile atmosferice provin de la mai multe surse sau c\u00e2nd aerul ambiental este poluat peste pragul de interven\u0163ie \u015fi nu este imediat posibil\u0103 identificarea principalei cauze a polu\u0103rii, autorit\u0103\u0163ile competente vor dispune monitorizarea suplimentar\u0103 pentru identificarea surselor polu\u0103rii. Dup\u0103 identificarea acestor surse, autorit\u0103\u0163ile competente vor dispune reducerea concentra\u0163iilor de poluan\u0163i \u00een emisii, astfel \u00eenc\u00e2t s\u0103 nu se dep\u0103\u015feasc\u0103 pragurile de interven\u0163ie. Dac\u0103 este necesar, autorit\u0103\u0163ile competente vor stabili obiective de remediere pentru concentra\u0163iile de poluan\u0163i \u00een emisii atmosferice sau \u00een aerul ambiental, care s\u0103 se situeze sub valorile pragului de interven\u0163ie.<\/p>\n<p><strong>Art. 16<\/strong><br \/>\nPrelevarea probelor de aer trebuie s\u0103 \u0163in\u0103 seama de urm\u0103toarele:<br \/>\na)laboratoarele care execut\u0103 analizarea poluan\u0163ilor \u00een emisii atmosferice sau \u00een aerul ambiental trebuie s\u0103 utilizeze metodologii adecvate, a\u015fa cum sunt stabilite prin standardele \u015fi reglement\u0103rile \u00een vigoare;<br \/>\nb)\u00een situa\u0163iile \u00een care nu exist\u0103 metodologii de prelevare \u015fi analiz\u0103 pentru anumi\u0163i poluan\u0163i, acestea vor fi stabilite, la cererea autorit\u0103\u0163ilor competente, prin studii efectuate de institute specializate. Costul acestor studii va fi suportat de titularul activit\u0103\u0163ii care genereaz\u0103 ace\u015fti poluan\u0163i;<br \/>\nc)r\u0103spunderea pentru acurate\u0163ea \u015fi precizia rezultatelor analitice asupra concentra\u0163iilor de poluan\u0163i \u00een emisiile atmosferice sau \u00een aerul ambiental revine p\u0103r\u0163ii care preleveaz\u0103 probele \u015fi laboratorului care execut\u0103 analizele.<br \/>\nCAPITOLUL V: Reglement\u0103ri privind evaluarea polu\u0103rii apelor de suprafa\u0163\u0103 \u015fi subterane<\/p>\n<p><strong>Art. 17<\/strong><br \/>\nPragurile de alert\u0103 \u015fi pragurile de interven\u0163ie privind poluarea apelor se definesc \u00een modul urm\u0103tor:<br \/>\na)dep\u0103\u015firile concentra\u0163iilor maxime admise de poluan\u0163i, prev\u0103zute de reglement\u0103rile \u00een vigoare, reprezint\u0103 pragurile de interven\u0163ie pentru poluarea apelor de suprafa\u0163\u0103 \u015fi subterane, precum \u015fi pentru evacu\u0103rile de ape uzate;<br \/>\nb)pragurile de alert\u0103 pentru concentra\u0163iile de poluan\u0163i \u00een apele de suprafa\u0163\u0103 sau subterane, precum \u015fi evacu\u0103rile de ape uzate reprezint\u0103 70% din pragurile de interven\u0163ie ale acelora\u015fi poluan\u0163i;<br \/>\nc)importan\u0163a polu\u0103rii apelor de suprafa\u0163\u0103 si subterane, precum \u015fi a evacu\u0103rilor de ape uzate cu substan\u0163e chimice \u015fi al\u0163i agen\u0163i poluan\u0163i, care nu sunt \u00eenscri\u015fi \u00een reglement\u0103rile legale existente, vor fi estimate prin studii efectuate de institu\u0163ii specializate \u015fi costul acestora va fi suportat de c\u0103tre unitatea poluatoare.<\/p>\n<p><strong>Art. 18<\/strong><br \/>\nRelevan\u0163a pragurilor de alert\u0103 \u015fi de interven\u0163ie \u00een procesul de interpretare \u015fi decizie al autorit\u0103\u0163ii competente determin\u0103 urm\u0103toarele situa\u0163ii:<br \/>\na)c\u00e2nd concentra\u0163iile de poluan\u0163i \u00een apele de suprafa\u0163\u0103 sau subterane, precum \u015fi \u00een evacu\u0103rile de ape uzate, se situeaz\u0103 sub nivelurile de alert\u0103, nu este necesar\u0103 stabilirea unor masuri speciale de c\u0103tre autoritatea competent\u0103;<br \/>\nb)c\u00e2nd concentra\u0163iile unuia sau mai multor poluan\u0163i dep\u0103\u015fesc pragul de alert\u0103, dar se situeaz\u0103 sub pragul de interven\u0163ie pentru apele de suprafa\u0163\u0103 \u015fi subterane, precum \u015fi pentru evacu\u0103rile de ape uzate, se consider\u0103 c\u0103 exist\u0103 impact poten\u0163ial asupra apelor. \u00cen aceste situa\u0163ii autorit\u0103\u0163ile competente pot dispune reducerea concentra\u0163iilor de poluan\u0163i \u00een evacu\u0103rile de ape uzate \u015fi efectuarea unei monitoriz\u0103ri suplimentare a surselor identificate sau poten\u0163iale de poluare;<br \/>\nc)c\u00e2nd concentra\u0163iile unuia sau mai multor poluan\u0163i din apele de suprafa\u0163\u0103 sau subterane sau din evacu\u0103rile de ape uzate dep\u0103\u015fesc pragul de interven\u0163ie, se consider\u0103 c\u0103 exist\u0103 impact asupra apelor. C\u00e2nd poluarea provine dintr-o singur\u0103 surs\u0103, autoritatea competent\u0103 va dispune reducerea concentra\u0163iilor de poluan\u0163i din evacu\u0103rile de ape uzate, astfel \u00eenc\u00e2t acestea s\u0103 nu dep\u0103\u015feasc\u0103 valorile pragului de interven\u0163ie. C\u00e2nd poluarea provine din contribu\u0163ia mai multor surse \u015fi\/sau nu este posibil\u0103 identificarea imediat\u0103 a principalei cauze a polu\u0103rii, autoritatea competent\u0103 va dispune monitorizarea suplimentar\u0103, pentru a identifica contribu\u0163ia fiec\u0103rei surse la poluarea identificat\u0103 \u015fi efectele cumulative ale acestora. \u00cen func\u0163ie de evaluarea efectelor cumulative, autoritatea competent\u0103 poate stabili reducerea concentra\u0163iilor de poluan\u0163i \u00een evacu\u0103rile de ape uzate, fix\u00e2nd ca obiective de remediere concentra\u0163ii de poluan\u0163i \u00een evacu\u0103ri situate sub valorile concentra\u0163iilor maxime admise, stabilite anterior prin actul de reglementare.<\/p>\n<p><strong>Art. 19<\/strong><br \/>\nPrelevarea \u015fi analizarea probelor de ap\u0103 trebuie s\u0103 \u0163in\u0103 seama de urm\u0103toarele:<br \/>\na)analiza concentra\u0163iilor de poluan\u0163i \u00een apele de suprafa\u0163\u0103 sau subterane, precum \u015fi \u00een evacu\u0103rile de ape uzate se va executa prin laboratoare de specialitate care utilizeaz\u0103 metodologii adecvate, \u00een conformitate cu standardele \u015fi reglement\u0103rile \u00een vigoare;<br \/>\nb)\u00een situa\u0163iile \u00een care nu exist\u0103 metodologii de prelevare \u015fi analiz\u0103 pentru anumi\u0163i poluan\u0163i, acestea vor fi stabilite, la cererea autorit\u0103\u0163ilor competente, prin studii efectuate de institute specializate.
