(3) \u015fi pct. 1.2.6 din anexa nr. 11 din Legea apelor nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare,<br \/>\nGuvernul Rom\u00e2niei adopt\u0103 prezenta hot\u0103r\u00e2re.<\/p>\n<p><strong>Art. 1<\/strong><br \/>\nSe aprob\u0103 Programul de eliminare treptat\u0103 a evacu\u0103rilor, emisiilor \u015fi pierderilor de substan\u0163e prioritar periculoase prev\u0103zut \u00een anexa nr. 1.<\/p>\n<p><strong>Art. 2<\/strong><br \/>\nSe aprob\u0103 Lista substan\u0163elor prioritare \u00een domeniul apei, prev\u0103zut\u0103 \u00een anexa nr. 2, \u00een conformitate cu prevederile art. 212 lit. d) din Legea apelor nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<\/p>\n<p><strong>Art. 3<\/strong><br \/>\nSe aprob\u0103 Lista specifica\u0163iilor tehnice \u015fi metodele standardizate pentru analiza \u015fi monitoringul st\u0103rii apelor prev\u0103zute \u00een anexa nr. 3, \u00een conformitate cu prevederile art. 36 alin. (3) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<\/p>\n<p><strong>Art. 4<\/strong><br \/>\n(1)\u00cen \u00een\u0163elesul prezentei hot\u0103r\u00e2ri, termenii \u015fi expresiile de mai jos au urm\u0103toarele semnifica\u0163ii:<br \/>\na)matrice \u2013 un compartiment al mediului acvatic, respectiv ap\u0103, sedimente sau biot\u0103;<br \/>\nb)taxon al biotei \u2013 un anumit taxon acvatic \u00een cadrul categoriei taxonomice \u201csub\u00eencreng\u0103tur\u0103\u201d, \u201cclas\u0103\u201d sau un echivalent al acestora;<br \/>\nc)limit\u0103 de detec\u0163ie (LOD) \u2013 semnalul de ie\u015fire sau valoarea concentra\u0163iei peste care se poate afirma, cu un nivel de \u00eencredere indicat, c\u0103 o prob\u0103 este diferit\u0103 de o prob\u0103 martor care nu con\u0163ine respectiva substan\u0163\u0103 analizat\u0103;<br \/>\nd)limit\u0103 de cuantificare (LOQ) \u2013 un multiplu definit al limitei de detec\u0163ie pentru o concentra\u0163ie a substan\u0163ei analizate care poate fi rezonabil determinat\u0103 la un nivel acceptabil de acurate\u0163e \u015fi precizie; limita de cuantificare poate fi calculat\u0103 utiliz\u00e2nd un standard adecvat sau o prob\u0103 adecvat\u0103 \u015fi poate fi ob\u0163inut\u0103 din cel mai jos punct de pe curba de calibrare, excluz\u00e2nd proba martor;<br \/>\ne)incertitudinea de m\u0103surare \u2013 valoarea absolut\u0103 a parametrului care caracterizeaz\u0103 dispersia valorilor cantitative atribuite substan\u0163ei analizate, pe baza informa\u0163iilor utilizate;<br \/>\nf)principalii poluan\u0163i \u2013 poluan\u0163ii defini\u0163i la pct. 46 din anexa nr. 1 la Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<br \/>\ng)standarde de calitate \u2013 norme de calitate definite de art. 212 lit. d) \u015fi de pct. 69 din anexa nr. 1 la Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<br \/>\n(2)De asemenea, pentru punerea \u00een aplicare a prezentei hot\u0103r\u00e2ri se aplic\u0103 \u015fi defini\u0163iile prev\u0103zute la anexa nr. 1 la Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<\/p>\n<p><strong>Art. 5<\/strong><br \/>\nAnexele nr. 1-3 fac parte integrant\u0103 din prezenta hot\u0103r\u00e2re.<\/p>\n<p><strong>Art. 6<\/strong><br \/>\nLa data intr\u0103rii \u00een vigoare a prezentei hot\u0103r\u00e2ri se abrog\u0103 Hot\u0103r\u00e2rea Guvernului nr. 351\/2005 privind aprobarea Programului de m\u0103suri \u00eempotriva polu\u0103rii cu substan\u0163e chimice, publicat\u0103 \u00een Monitorul Oficial al Rom\u00e2niei, Partea I, nr. 428 din 20 mai 2005, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<\/p>\n<p>Prezenta hot\u0103r\u00e2re transpune;<br \/>\na)Directiva 2008\/105\/CE a Parlamentului European \u015fi a Consiliului din 16 decembrie 2008 privind standardele de calitate a mediului \u00een domeniul apei, de modificare \u015fi de abrogare a Directivelor 82\/176\/CEE, 83\/513\/CEE, 84\/156\/CEE, 84\/491\/CEE, 86\/280\/CEE ale Consiliului \u015fi de modificare a Directivei 2000\/60\/CE, publicat\u0103 \u00een Jurnalul Oficial al Uniunii Europene, seria L, nr. 348 din 24 decembrie 2008, cu excep\u0163ia articolului 10;<br \/>\nb)Directiva 2009\/90\/CE a Comisiei din 31 iulie 2009 de stabilire, \u00een temeiul Directivei 2000\/60\/CE a Parlamentului European \u015fi a Consiliului, a specifica\u0163iilor tehnice pentru analiza chimic\u0103 \u015fi monitorizarea st\u0103rii apelor, publicat\u0103 \u00een Jurnalul Oficial al Uniunii Europene seria L, nr. 201 din 1 august 2009;<br \/>\nc)Directiva 2013\/39\/UE a Parlamentului European \u015fi a Consiliului din 12 august 2013 de modificare a Directivelor 2000\/60\/CE \u015fi 2008\/105\/CE \u00een ceea ce prive\u015fte substan\u0163ele prioritare din domeniul politicii apei, publicat\u0103 \u00een Jurnalul Oficial al Uniunii Europene, seria L, nr. 226 din 24 august 2013.<br \/>\nPRIM-MINISTRU<br \/>\nDACIAN JULIEN CIOLO\u015e<br \/>\nContrasemneaz\u0103:<br \/>\nMinistrul mediului,<br \/>\napelor \u015fi p\u0103durilor,<br \/>\nCristiana Pa\u015fca Palmer<br \/>\nMinistrul afacerilor externe,<br \/>\nLaz\u0103r Com\u0103nescu<br \/>\nMinistrul finan\u0163elor publice,<br \/>\nAnca Dana Dragu<\/p>\n<p>ANEXA nr. 1: PROGRAMUL de eliminare treptat\u0103 a evacu\u0103rilor, emisiilor \u015fi pierderilor de substan\u0163e prioritar periculoase<\/p>\n<p><strong>Art. 1<\/strong><br \/>\n(1)\u00cen vederea ob\u0163inerii unei st\u0103ri chimice bune a apelor de suprafa\u0163\u0103 \u015fi \u00een conformitate cu dispozi\u0163iile \u015fi obiectivele stabilite la art. 21 din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, prezentul program de eliminare treptat\u0103 a evacu\u0103rilor, emisiilor \u015fi pierderilor de substan\u0163e prioritar periculoase, denumit \u00een continuare Program, stabile\u015fte m\u0103surile tehnice \u015fi cadrul institu\u0163ional pentru:<br \/>\na)aplicarea standardelor de calitate a mediului (SCM) pentru substan\u0163ele prioritare \u015fi principalii poluan\u0163i, prev\u0103zute \u00een anexa nr. 1 partea A la program;<br \/>\nb)modalit\u0103\u0163ile de aplicare a acestor standarde de calitate a mediului la apele de suprafa\u0163\u0103, prev\u0103zute \u00een anexa nr. 1 partea B la program, \u015fi termenele de atingere ale acestor standarde, prev\u0103zute \u00een art. 3 la program.<br \/>\n(2)Prezentul program cuprinde toate m\u0103surile aplicate apelor de suprafa\u0163\u0103 pentru reducerea polu\u0103rii cu substan\u0163e prioritare \u015fi principalii poluan\u0163i sau eliminarea polu\u0103rii cu substan\u0163e prioritar periculoase, provenite din toate sursele de poluare ale activit\u0103\u0163ii umane, care pot afecta calitatea apelor de suprafa\u0163\u0103, prin atingerea standardelor de calitate prev\u0103zute la alin. (1) lit. a), \u00een conformitate cu prevederile art. 21 lit. d) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<\/p>\n<p><strong>Art. 2<\/strong><br \/>\n(1)Autoritatea public\u0103 central\u0103 \u00een domeniul apelor este desemnat\u0103 autoritatea responsabil\u0103 pentru coordonarea \u015fi supervizarea m\u0103surilor desf\u0103\u015furate \u00een temeiul prezentului program \u015fi raportarea rezultatelor acestor m\u0103suri la Comisia European\u0103, denumit\u0103 \u00een continuare autoritate responsabil\u0103.<br \/>\n(2)Administra\u0163ia Na\u0163ional\u0103 \u201cApele Rom\u00e2ne\u201d este desemnat\u0103 autoritatea competent\u0103 pentru aplicarea m\u0103surilor din prezentul program, \u00een conformitate cu prevederile art. 3 alin. (1) lit. a) \u015fi h) \u015fi alin. (2) lit. d) din Ordonan\u0163a de urgen\u0163\u0103 a Guvernului nr. 107\/2002 privind \u00eenfiin\u0163area Administra\u0163iei Na\u0163ionale \u201cApele Rom\u00e2ne\u201d, aprobat\u0103 cu modific\u0103ri prin Legea nr. 404\/2003, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, denumit\u0103 \u00een continuare autoritate competent\u0103.<br \/>\n(3)\u00cen scopul implement\u0103rii programului, autoritatea competent\u0103 adopt\u0103 m\u0103suri adecvate \u00een toate activit\u0103\u0163ile care au ca scop conservarea, protec\u0163ia \u015fi \u00eembun\u0103t\u0103\u0163irea apelor de suprafa\u0163\u0103 \u015fi a mediului acvatic, \u00een conformitate cu prevederile art. 2 lit. l) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<\/p>\n<p><strong>Art. 3<\/strong><br \/>\n(1)\u00cen scopul atingerii unei st\u0103ri chimice bune a apelor de suprafa\u0163\u0103 \u00een termenele stabilite potrivit prezentului articol, prin aplicarea SCM-urilor aprobate \u00een prezentul program pentru substan\u0163ele prioritar periculoase, autoritatea competent\u0103 aplic\u0103 SCM-urile prev\u0103zute \u00een anexa nr. 1 partea A, respect\u00e2nd cerin\u0163ele prev\u0103zute \u00een partea B, astfel:<br \/>\na)pentru substan\u0163ele prev\u0103zute la nr. crt. 2, 5, 15, 20, 22, 23, 28 din anexa nr. 1 partea A, cu \u00eencepere de la data intr\u0103rii \u00een vigoare a prezentului program p\u00e2n\u0103 la 22 decembrie 2021, se stabilesc programele de m\u0103suri necesare acestor substan\u0163e \u015fi se includ \u00een planurile de management al bazinelor hidrografice elaborate periodic, \u00een conformitate cu art. 43 alin. (19) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<br \/>\nb)pentru substan\u0163ele nou-identificate prev\u0103zute la nr. crt. 34-45 \u00een anexa nr. 1 partea A, autoritatea competent\u0103 elaboreaz\u0103 \u015fi \u00eenainteaz\u0103 Comisiei Europene, p\u00e2n\u0103 la 22 decembrie 2018, un program de monitorizare suplimentar\u0103 \u015fi un program preliminar de m\u0103suri pentru substan\u0163ele respective, care s\u0103 fie implementate cu \u00eencepere de la 22 decembrie 2018 p\u00e2n\u0103 la 22 decembrie 2027, \u00een scopul prevenirii deterior\u0103rii st\u0103rii chimice a corpurilor de ap\u0103 de suprafa\u0163\u0103, \u00een conformitate cu art. 20, 43 \u015fi anexa nr. 3 din Legea apelor nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare. Programul final de m\u0103suri se stabile\u015fte cel t\u00e2rziu p\u00e2n\u0103 la 22 decembrie 2021 \u015fi aplic\u0103 prevederile art. 23, 24, 25, 27, 29 \u015fi 43 din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, ca atare, schimb\u00e2nd ceea ce este de schimbat \u015fi f\u0103r\u0103 nicio modificare \u00een ceea ce prive\u015fte substan\u0163ele prev\u0103zute la alin. (1) lit. a) \u015fi b), devenind pe deplin opera\u0163ional c\u00e2t mai cur\u00e2nd posibil dup\u0103 aceast\u0103 dat\u0103, dar nu mai t\u00e2rziu de 22 decembrie 2024.<br \/>\n(2)Pentru substan\u0163ele prev\u0103zute la nr. crt. 5, 15, 16, 17, 21, 28, 34, 35, 37, 43 \u015fi 44 din anexa nr. 1 partea A, autoritatea competent\u0103 aplic\u0103 SCM-urile pentru biot\u0103 stabilite \u00een anexa nr. 1 partea A.<br \/>\n(3)Pentru alte substan\u0163e din anexa nr. 1 dec\u00e2t cele prev\u0103zute la alin. (2), autoritatea competent\u0103 aplic\u0103 SCM-urile pentru ap\u0103 stabilite \u00een anexa nr. 1 partea A.<br \/>\n(4)Autoritatea competent\u0103 poate decide, pentru una sau mai multe ape de suprafa\u0163\u0103, s\u0103 aplice un SCM pentru o matrice diferit\u0103 de cea specificat\u0103 la alin. (2) sau pentru taxoni ai biotei diferi\u0163i de cei specifica\u0163i \u00een anexa nr. 1 partea A, dac\u0103 este relevant.<br \/>\n(5)Dac\u0103 autoritatea competent\u0103 utilizeaz\u0103 op\u0163iunea prev\u0103zut\u0103 la alin. (4), aplic\u0103 SCM-ul corespunz\u0103tor stabilit \u00een anexa nr. 1 partea A; dac\u0103 \u00een anexa nr. 1 partea A nu este prev\u0103zut niciun SCM pentru matricea sau pentru taxonul biotei alese, autoritatea competent\u0103 stabile\u015fte \u015fi utilizeaz\u0103 un SCM care s\u0103 ofere cel pu\u0163in acela\u015fi nivel de protec\u0163ie ca SCM-ul prev\u0103zut \u00een anexa nr. 1 partea A.<br \/>\n(6)Autoritatea competent\u0103 poate utiliza op\u0163iunea prev\u0103zut\u0103 la alin. (4) \u015fi (5) numai dac\u0103 metoda de analiz\u0103 aleas\u0103 pentru matricea sau taxonul biotei selectate \u00eendepline\u015fte criteriile minime de performan\u0163\u0103 prev\u0103zute la pct. 2 \u015fi 3 din anexa nr. 3 la hot\u0103r\u00e2re; dac\u0103 aceste criterii nu sunt \u00eendeplinite pentru nicio matrice, autoritatea competent\u0103 se asigur\u0103 c\u0103 monitorizarea se efectueaz\u0103 prin utilizarea celor mai bune tehnici disponibile care nu presupun costuri excesive \u015fi c\u0103 metoda de analiz\u0103 func\u0163ioneaz\u0103 cel pu\u0163in la fel de bine precum cea disponibil\u0103 pentru matricea specificat\u0103 la alin. (3) pentru substan\u0163a \u00een cauz\u0103, astfel:<br \/>\na)dac\u0103 a fost identificat, \u00een urma unei expuneri acute, un poten\u0163ial risc pentru sau prin intermediul mediului acvatic ca rezultat al concentra\u0163iilor ori emisiilor m\u0103surate sau estimate, autoritatea competent\u0103 se asigur\u0103 c\u0103, unde se aplic\u0103 SCM pentru biot\u0103 ori sediment, monitorizarea se efectueaz\u0103 \u015fi \u00een apele de suprafa\u0163\u0103 \u015fi aplic\u0103 standardele de calitate de mediu \u2013 concentra\u0163ia maxim\u0103 admisibil\u0103 (SCM \u2013 CMA) din anexa nr. 1 partea A la program, atunci c\u00e2nd acestea sunt stabilite;<br \/>\nb)dac\u0103, \u00een conformitate cu prevederile pct. 4 \u2013 6 din anexa nr. 3 la hot\u0103r\u00e2re, valoarea medie calculat\u0103 a m\u0103sur\u0103torilor, pentru substan\u0163a care se m\u0103soar\u0103, este considerat\u0103 \u201cinferioar\u0103 limitei de cuantificare\u201d a celei mai bune tehnici disponibile care nu presupune costuri excesive, iar \u201climita de cuantificare\u201d a acelei tehnici este superioar\u0103 SCM, rezultatele acestor m\u0103sur\u0103tori nu se iau \u00een considerare la evaluarea st\u0103rii chimice globale a respectivului corp de ap\u0103.<br \/>\n(7)\u00cen cazul substan\u0163elor pentru care este aplicat un SCM pentru sedimente \u015fi\/sau biot\u0103, autoritatea competent\u0103 monitorizeaz\u0103 substan\u0163a \u00een matricea relevant\u0103 cel pu\u0163in o dat\u0103 pe an, except\u00e2nd cazurile \u00een care cuno\u015ftin\u0163ele tehnice \u015fi opinia exper\u0163ilor justific\u0103 un alt interval.<br \/>\n(8)Autoritatea competent\u0103 include \u00een impactul revizuit al activit\u0103\u0163ilor umane asupra st\u0103rii corpurilor de ap\u0103, parte a planurilor actualizate de management a bazinelor hidrografice ce se constituie ca parte component\u0103 de gospod\u0103rire calitativ\u0103 a schemelor directoare, elaborate \u00een conformitate cu art. 43 alin. (1) \u015fi (15) corelat cu art. 22 \u015fi 210 din Legea apelor nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, urm\u0103toarele actualiz\u0103ri:<br \/>\na)tabelul cu limitele de cuantificare actualizate ale metodelor de analiz\u0103 aplicate, precum \u015fi performan\u0163a actualizat\u0103 a acestor metode fa\u0163\u0103 de criteriile minime de performan\u0163\u0103 stabilite la pct. 2 \u015fi 3 din anexa nr. 3 la hot\u0103r\u00e2re;<br \/>\nb)pentru substan\u0163ele \u00een cazul c\u0103rora s-a utilizat op\u0163iunea prev\u0103zut\u0103 la alin. (4)-6):<br \/>\n1.(i) motivele \u015fi baza utiliz\u0103rii op\u0163iunii respective;<br \/>\n2.(ii) dup\u0103 caz, SCM-urile alternative actualizate stabilite, dovezi ale faptului c\u0103 aceste SCM-uri ofer\u0103 cel pu\u0163in acela\u015fi nivel de protec\u0163ie ca \u015fi SCM-urile prev\u0103zute \u00een anexa nr. 1 partea A, inclusiv datele \u015fi metodologia utilizate pentru determinarea SCM-urilor alternative, precum \u015fi actualizarea categoriilor de ap\u0103 de suprafa\u0163\u0103 pentru care acestea se aplic\u0103;<br \/>\n3.(iii) pentru compara\u0163ie cu informa\u0163iile prev\u0103zute la lit. a), limitele de cuantificare ale metodelor de analiz\u0103 pentru matricea sau matricele specificate \u00een anexa nr. 1 partea A, inclusiv informa\u0163ii cu privire la performan\u0163a acestor metode fa\u0163\u0103 de criteriile minime de performan\u0163\u0103 stabilite la pct. 2 \u015fi 3 din anexa nr. 3 la hot\u0103r\u00e2re;<br \/>\nc)justificarea frecven\u0163ei monitoriz\u0103rii aplicate \u00een conformitate cu alin. (7), dac\u0103 intervalele de monitorizare dep\u0103\u015fesc 1 an;<br \/>\nd)lista de \u201cprincipali poluan\u0163i\u201d identifica\u0163i la nivel na\u0163ional \u00een cantit\u0103\u0163i relevante, din lista prev\u0103zuta \u00een anexa nr. 6 din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, \u00een cadrul revizuirii impactului \u015fi presiunilor generate de activit\u0103\u0163ile umane asupra st\u0103rii corpurilor de ap\u0103, \u00een conformitate cu prevederile subpct. 1.4 lit. a) \u015fi b) pct. 1 din anexa nr. 13 la Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, care sunt evacua\u0163i \u00een cantit\u0103\u0163i relevante odat\u0103 cu apele uzate \u015fi au impact semnificativ la nivelul corpurilor de ape de suprafa\u0163\u0103 din bazinul hidrografic na\u0163ional, \u00een scopul aplic\u0103rii prevederilor art. 28 alin. (2) al pct. 1.3.3 din anexa nr. 11 la Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, \u015fi ale alin. (8), la propunerea autorit\u0103\u0163ii competente.<br \/>\n(10)Autoritatea competent\u0103 ia m\u0103surile necesare pentru a se asigura c\u0103 at\u00e2t planurile actualizate de management a bazinelor hidrografice, elaborate \u00een conformitate cu art. 43 alin. (15) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, \u015fi care con\u0163in rezultatele \u015fi impactul m\u0103surilor \u00eentreprinse pentru prevenirea polu\u0103rii chimice a apelor de suprafa\u0163\u0103, c\u00e2t \u015fi raportul intermediar cuprinz\u00e2nd progresele \u00eenregistrate \u00een punerea \u00een aplicare a programelor de m\u0103suri, planificate \u00een conformitate cu art. 441 alin. (3) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, sunt publicate pe site-ul autorit\u0103\u0163ii competente.<br \/>\n(11)Autoritatea competent\u0103 ia m\u0103suri pentru analiza evolu\u0163iei pe termen lung a concentra\u0163iilor substan\u0163elor prev\u0103zute la nr. crt. 2, 5, 6, 7, 12, 15-18, 20, 21, 26, 28, 30, 34-37, 43 \u015fi 44 prev\u0103zute \u00een anexa nr. 1 partea A, care tind s\u0103 se acumuleze \u00een sedimente \u015fi\/sau \u00een biot\u0103, monitoriz\u00e2nd aceste substan\u0163e \u015fi \u00een sedimente \u015fi\/sau biot\u0103 dac\u0103 analiza tendin\u0163elor realizat\u0103 numai pe baza monitoriz\u0103rii st\u0103rii apei de suprafa\u0163\u0103, efectuate \u00een conformitate cu art. 35 din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, nu este relevant\u0103. Autoritatea competent\u0103 ia m\u0103suri pentru a se asigura, pentru aplicarea art. 21-25 \u015fi art. 43 din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, c\u0103 aceste concentra\u0163ii nu cresc \u00een mod considerabil \u00een sedimente \u015fi\/sau \u00een biota respectiv\u0103 \u00een timp; autoritatea competent\u0103 stabile\u015fte frecven\u0163a necesar\u0103 monitoriz\u0103rii sedimentelor \u015fi\/sau a biotei, astfel \u00eenc\u00e2t s\u0103 furnizeze suficiente date necesare pentru o analiz\u0103 credibil\u0103 a tendin\u0163elor pe termen lung \u015fi o propune spre aprobare autorit\u0103\u0163ii responsabile. Cea mai redus\u0103 frecven\u0163\u0103 de monitorizare acceptabil\u0103 este de o dat\u0103 la fiecare 3 ani, except\u00e2nd cazurile \u00een care cuno\u015ftin\u0163ele tehnice \u015fi opinia exper\u0163ilor justific\u0103 o frecven\u0163\u0103 mai mare.<br \/>\n(12)Pentru aplicarea prevederilor prezentului alineat se utilizeaz\u0103 ghidurile tehnice sau metodologiile comunitare relevante, existente la data intr\u0103rii \u00een vigoare a prezentei hot\u0103r\u00e2ri pentru:<br \/>\na)strategiile de monitorizare \u015fi metodele analitice aplicabile substan\u0163elor, inclusiv pentru prelevarea \u015fi monitorizarea biotei, pentru:<br \/>\nb)monitorizarea substan\u0163elor \u00een biot\u0103, astfel cum se prevede la alin. (2)-(6);<br \/>\nc)metode analitice care respect\u0103 criteriile minime de performan\u0163\u0103 stabilite la pct. 2 \u015fi 3 din anexa nr. 3 la hot\u0103r\u00e2re, \u00een cazul substan\u0163elor noi, numerotate de la 34 la 45 \u00een anexa nr. 1 partea A, precum \u015fi al substan\u0163elor pentru care SCM-urile din anexa nr. 1 partea A sunt mai stricte dec\u00e2t cele stabilite pentru primul plan de management aprobat prin Hot\u0103r\u00e2rea Guvernului nr. 80\/2011, respectiv substan\u0163ele prev\u0103zute la nr. crt. 2, 5, 15, 20, 22, 23 \u015fi 28 din anexa nr. 1 partea A.<br \/>\n(13)\u00cen cazul substan\u0163elor pentru care nu au fost elaborate ghiduri tehnice la data intr\u0103rii \u00een vigoare a prezentei hot\u0103r\u00e2ri, termenul prev\u0103zut la alin. (1) lit. a) se stabile\u015fte p\u00e2n\u0103 la data de 22 decembrie 2018, respectiv p\u00e2n\u0103 la data de 22 decembrie 2027.<\/p>\n<p><strong>Art. 4<\/strong><br \/>\n(1)\u00cen planurile de management al bazinelor hidrografice, elaborate \u00een conformitate cu art. 6, art. 43 alin. (14) \u015fi (15), art. 441 alin. (2) \u015fi (3), art. 45 \u015fi anexa nr. 13 \u015fi \u00een completarea cerin\u0163elor pct. 1.4.3 din anexa nr. 11 la Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, referitoare la harta de prezentare a st\u0103rii chimice globale cu substan\u0163ele din anexa nr. 2 la hot\u0103r\u00e2re, care atest\u0103 atingerea obiectivelor \u015fi obliga\u0163iilor prev\u0103zute la art. 21 \u015fi anexa nr. 3 la Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, raportarea autorit\u0103\u0163ii competente poate avea forma unui set de h\u0103r\u0163i, c\u00e2te una pentru fiecare substan\u0163\u0103 prioritar\u0103 individual\u0103, pentru claritatea formatului de raportare; fiecare hart\u0103 include informa\u0163iile actualizate referitoare la starea chimic\u0103 pentru fiecare dintre substan\u0163ele prioritare prev\u0103zute la lit. a)-c) ob\u0163inute ca urmare a revizuirii impactului activit\u0103\u0163ilor umane, \u00een completarea informa\u0163iilor existente pentru restul de substan\u0163e din anexa nr. 1 partea A la prezentul program \u015fi raportate \u00een cadrul primului plan de management, aprobat prin Hot\u0103r\u00e2rea Guvernului nr. 80\/2011, astfel:<br \/>\na)substan\u0163ele prev\u0103zute la nr. crt. 5, 21, 28, 30, 35, 37, 43 \u015fi 44 \u2013 substan\u0163e care se comport\u0103 la fel ca substan\u0163ele persistente, bioacumulabile \u015fi toxice (PBT) omniprezente;<br \/>\nb)substan\u0163ele prev\u0103zute la nr. crt. 34-45 \u2013 substan\u0163e nou-identificate la revizuirea impactului;<br \/>\nc)substan\u0163ele prev\u0103zute la nr. crt. 2, 5, 15, 20, 22, 23 \u015fi 28 \u2013 substan\u0163e cu SCM-uri revizuite, mai stricte;<br \/>\n(2)Autoritatea competent\u0103 poate prezenta \u015fi marja de deviere de la valorile SCM pentru fiecare dintre substan\u0163ele prev\u0103zute la alin. (1), \u00een cadrul planurilor de management al bazinelor hidrografice men\u0163ionate la alin. (1).<br \/>\n(3)Autoritatea competent\u0103 elaboreaz\u0103 aceste h\u0103r\u0163i individuale pentru a asigura intercomparabilitatea acestora \u00een raportarea global\u0103 la nivel de bazin hidrografic interna\u0163ional \u015fi la nivel comunitar.<br \/>\n(4)Autoritatea competent\u0103 poate monitoriza substan\u0163ele prev\u0103zute la nr. crt. 5, 21, 28, 30, 35, 37, 43 \u015fi 44 din anexa nr. 1 partea A cu o frecven\u0163\u0103 mai mic\u0103 dec\u00e2t frecven\u0163a anual\u0103 prev\u0103zut\u0103 \u00een art. 3 alin. (7) din program \u015fi prevederile din anexa nr. 11 la Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, \u00een cazul substan\u0163elor prioritare, cu condi\u0163ia ca monitorizarea s\u0103 fie reprezentativ\u0103 \u015fi s\u0103 fie disponibil\u0103 o baz\u0103 statistic\u0103 solid\u0103 privind prezen\u0163a acestor substan\u0163e \u00een mediul acvatic. \u00cen conformitate cu prevederile art. 3 alin. (11) din program, monitorizarea se efectueaz\u0103 din 3 \u00een 3 ani, except\u00e2nd cazurile \u00een care cuno\u015ftin\u0163ele tehnice \u015fi opinia exper\u0163ilor justific\u0103 un alt interval.<\/p>\n<p><strong>Art. 5<\/strong><br \/>\n(1)Substan\u0163ele care pot prezenta risc semnificativ de persisten\u0163\u0103, bioacumulare \u015fi toxicitate la nivel comunitar pentru mediul acvatic sau prin intermediul mediului acvatic \u015fi pentru care datele de monitorizare existente la nivel comunitar sunt insuficiente fac parte din Lista de supraveghere, pentru care urmeaz\u0103 s\u0103 se colecteze date de monitorizare la nivel na\u0163ional, necesare aplic\u0103rii prevederilor art. 43 alin. (5) lit. a) \u015fi c) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<br \/>\n(2)Prima list\u0103 de supraveghere con\u0163ine 10 substan\u0163e sau grupuri de substan\u0163e \u015fi este adoptat\u0103 prin Decizia de punere \u00een aplicare (UE) 2015\/495 a Comisiei din 20 martie 2015 de stabilire a unei liste de supraveghere a substan\u0163elor pentru monitorizare la nivelul UE \u00een domeniul apei, \u00een temeiul Directivei 2008\/105\/CE a Parlamentului European \u015fi a Consiliului, publicat\u0103 \u00een Jurnalul Oficial al Uniunii Europene seria L, nr. 78 din 24 martie 2015; lista se poate completa cu c\u00e2te o substan\u0163\u0103 la fiecare actualizare a listei de supraveghere, p\u00e2n\u0103 la un num\u0103r maximum de 14 substan\u0163e.<br \/>\n(3)Autoritatea competent\u0103 monitorizeaz\u0103 fiecare dintre cele 10 substan\u0163e sau grupe de substan\u0163e din lista de supraveghere stabilit\u0103 prin Decizia 2015\/495\/CE pentru o perioad\u0103 de cel pu\u0163in 12 luni consecutive, \u00eencep\u00e2nd cu data intr\u0103rii \u00een vigoare a prezentului program, la sta\u0163iile de monitorizare reprezentative selectate la nivel na\u0163ional; pentru fiecare substan\u0163\u0103 inclus\u0103 ulterior \u00een lista de supraveghere actualizat\u0103 la nivel comunitar, autoritatea competent\u0103 \u00eencepe monitorizarea \u00een termen de 6 luni de la includerea \u00een lista actualizat\u0103.<br \/>\n(4)Autoritatea competent\u0103 selecteaz\u0103 num\u0103rul de sta\u0163ii de monitorizare na\u0163ionale reprezentative la nivel na\u0163ional, aplic\u00e2nd cumulat urm\u0103toarele patru criterii:<br \/>\na)cel pu\u0163in o sta\u0163ie de monitorizare la nivel na\u0163ional;<br \/>\nb)\u00eenc\u0103 o sta\u0163ie de monitorizare dac\u0103 statul membru respectiv are peste un milion de locuitori;<br \/>\nc)num\u0103rul de sta\u0163ii de monitorizare egal cu rezultatul ob\u0163inut prin \u00eemp\u0103r\u0163irea ariei sale geografice \u00een km2 la 60.000, rotunjit la num\u0103rul \u00eentreg cel mai apropiat;<br \/>\nd)num\u0103rul de sta\u0163ii de monitorizare egal cu rezultatul ob\u0163inut prin \u00eemp\u0103r\u0163irea popula\u0163iei sale la 5 milioane, rotunjit la num\u0103rul \u00eentreg cel mai apropiat.<br \/>\nLa alegerea sta\u0163iilor reprezentative de monitorizare, a frecven\u0163ei \u015fi a calendarului de monitorizare pentru fiecare substan\u0163\u0103, autoritatea competent\u0103 \u0163ine seam\u0103 de modurile de utilizare \u015fi de posibila apari\u0163ie a substan\u0163ei \u00een apele de suprafa\u0163\u0103; frecven\u0163a monitoriz\u0103rii este de cel pu\u0163in o dat\u0103 pe an.<br \/>\n(5)Dac\u0103 autoritatea competent\u0103 de\u0163ine date de monitorizare suficiente, comparabile, reprezentative \u015fi recente pentru o anumit\u0103 substan\u0163\u0103 sau grupe de substan\u0163e din cele 10, din programe sau studii de monitorizare existente pe plan na\u0163ional, altele dec\u00e2t programul de monitorizare prev\u0103zut la alin. (3), poate decide s\u0103 nu efectueze monitorizarea suplimentar\u0103 solicitat\u0103 pentru substan\u0163a respectiv\u0103 aflat\u0103 \u00een lista de supraveghere, cu condi\u0163ia ca substan\u0163a s\u0103 fi fost monitorizat\u0103 prin utilizarea unei metodologii care respect\u0103 cerin\u0163ele prev\u0103zute \u00een ghidurile tehnice comunitare elaborate pentru monitorizarea listei de supraveghere, \u00een conformitate cu prevederile alin. (3) \u015fi (4).<br \/>\n(6)Autoritatea responsabil\u0103 coordoneaz\u0103 activitatea de raportare c\u0103tre Comisia European\u0103 a rezultatelor monitoriz\u0103rii ob\u0163inute ca urmare a aplic\u0103rii prevederilor alin. (3)-(5), efectuat\u0103 de autoritatea competent\u0103. Rezultatele monitoriz\u0103rii substan\u0163elor din prima lista de supraveghere de 10 substan\u0163e se raporteaz\u0103 la data de 20 decembrie 2016 \u015fi ulterior la fiecare 12 luni, pe perioada \u00een care fiecare substan\u0163\u0103 dintre cele 10 este men\u0163inut\u0103 pe lista de supraveghere comunitar\u0103. Pentru fiecare substan\u0163\u0103 nou-inclus\u0103, autoritatea competent\u0103 raporteaz\u0103 Comisiei Europene rezultatele monitoriz\u0103rii, \u00een termen de 21 de luni de la includerea respectivei substan\u0163e \u00een lista de supraveghere \u015fi ulterior la fiecare 12 luni, pe perioada \u00een care respectiva substan\u0163\u0103 este men\u0163inut\u0103 pe lista de supraveghere comunitar\u0103. Raportul include \u015fi informa\u0163iile na\u0163ionale cu privire la reprezentativitatea sta\u0163iilor de monitorizare \u015fi la strategia de monitorizare, al\u0103turi de informa\u0163iile solicitate de Decizia 2015\/495\/CE.<\/p>\n<p><strong>Art. 6<\/strong><br \/>\n(1)Autoritatea competent\u0103 poate desemna zone de amestec adiacente punctelor de evacuare, zone \u00een care concentra\u0163iile uneia sau mai multor substan\u0163e din anexa A pot dep\u0103\u015fi SCM-uriie stabilite, cu condi\u0163ia ca aceste zone s\u0103 nu afecteze conformitatea restului corpului de ap\u0103 de suprafa\u0163\u0103 cu aceste SCM.<br \/>\n(2)Zonele de amestec desemnate de autoritatea competent\u0103, \u00een conformitate cu prevederile alin. (1), se includ \u00een planul na\u0163ional de management al bazinului hidrografic al Dun\u0103rii de pe teritoriul Rom\u00e2niei, delimitat \u00een conformitate cu prevederile art. 6 alin. (3) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare. Informa\u0163iile referitoare la zonele de amestec includ:<br \/>\na)abord\u0103rile \u015fi metodologiile aplicate pentru a identifica \u015fi desemna zonele de amestec; \u015fi<br \/>\nb)m\u0103surile adoptate \u00een vederea reducerii pe viitor a \u00eentinderii zonelor de amestec; aceste m\u0103suri aplic\u0103 prevederile anexei nr. 3 pct. C lit. k) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, sau reglement\u0103rile privind autorizarea emisiilor industriale prev\u0103zute \u00een anexa nr. 3 pct. C lit. g) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, sau din Legea nr. 278\/2013 privind emisiile industriale, reglement\u0103ri care se includ \u00een autoriza\u0163iile revizuite, acordate pentru toate emisiile industriale care sunt evacuate \u00een zonele de amestec desemnate.<br \/>\n(3)La desemnarea zonelor de amestec, autoritatea competent\u0103 se asigur\u0103 c\u0103 suprafa\u0163a oric\u0103rei astfel de zone este:<br \/>\na)restric\u0163ionat\u0103 la proximitatea punctului de evacuare;<br \/>\nb)propor\u0163ional\u0103 \u00een raport cu concentra\u0163iile de substan\u0163e prioritare din emisiile industriale de la punctul de evacuare ce con\u0163in aceste substan\u0163e; aceste concentra\u0163ii, stabilite \u00een conformitate cu cele mai bune tehnici disponibile, se includ \u00een autoriza\u0163iile revizuite \u00een conformitate cu prevederile alin. (2) sau al oric\u0103ror altor prevederi legislative na\u0163ionale \u015fi comunitare privind emisiile de substan\u0163e, \u00een scopul aplic\u0103rii prevederilor art. 28 \u015fi art. 43 alin. (5) lit. b) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare; autoriza\u0163iile revizuite includ \u015fi revizuirea procedurilor de control adecvate emisiilor industriale revizuite.<\/p>\n<p><strong>Art. 7<\/strong><br \/>\n(1)Autoritatea responsabil\u0103 \u015fi autoritatea competent\u0103 nu \u00eencalc\u0103 obliga\u0163iile stabilite prin prezentul program prin dep\u0103\u015firea limitei impuse de un SCM, \u00een cazul \u00een care poate demonstra c\u0103:<br \/>\na)dep\u0103\u015firea s-a datorat unei surse de poluare din afara jurisdic\u0163iei na\u0163ionale a acestuia;<br \/>\nb)din cauza unei astfel de polu\u0103ri transfrontaliere nu a putut lua m\u0103suri eficiente pentru a se conforma cu SCM-urile relevante; \u015fi<br \/>\nc)a aplicat mecanismele de coordonare stabilite la art. 6 din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, sau, dup\u0103 caz, a recurs la dispozi\u0163iile art. 23, 24, 25 \u015fi 43 din Legea nr. 107\/1996, cu complet\u0103rile \u015fi modific\u0103rile ulterioare, pentru corpurile de ap\u0103 afectate de poluarea transfrontalier\u0103.<br \/>\n(2)Autoritatea responsabil\u0103 \u015fi autoritatea competent\u0103 utilizeaz\u0103 mecanismul prev\u0103zut la art. 443 din Legea nr. 107\/1996, cu modific\u0103rile \u015fi ulterioare, pentru a furniza Comisiei informa\u0163iile necesare \u00een situa\u0163iile prev\u0103zute la alin. (1), precum \u015fi un rezumat al m\u0103surilor adoptate \u00een leg\u0103tur\u0103 cu poluarea transfrontalier\u0103, \u00een cadrul planului de management al bazinului hidrografic \u00een cauz\u0103, \u00een conformitate cu obliga\u0163iile de raportare prev\u0103zute la art. 441 din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<\/p>\n<p><strong>Art. 8<\/strong><br \/>\n(1)Pe baza informa\u0163iilor ob\u0163inute prin aplicarea prevederilor art. 35 \u015fi art. 43 alin. (14) \u015fi (15) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, \u00een temeiul Regulamentului (CE) nr. 166\/2006 al Parlamentului European \u015fi al Consiliului din 18 ianuarie 2006 de instituire a unui registru european al emisiilor \u015fi transferului de poluan\u0163i \u015fi de modificare a Directivelor 91\/689\/CEE \u015fi 96\/61\/CE ale Consiliului \u015fi al altor date disponibile referitoare la emisiile, evacu\u0103rile \u015fi pierderile de substan\u0163e prioritar periculoase \u015fi principalii poluan\u0163i, autoritatea competent\u0103 elaboreaz\u0103 un inventar al emisiilor, evacu\u0103rilor \u015fi pierderilor pentru toate substan\u0163ele vizate de prezentul program, pentru fiecare district de bazin hidrografic sau parte a unui district de bazin hidrografic.<br \/>\n(2)Inventarul prev\u0103zut la alin. (1) include \u015fi h\u0103r\u0163i ale emisiilor, evacu\u0103rilor \u015fi pierderilor pentru toate substan\u0163ele prev\u0103zute \u00een anexa nr. 1 partea A, precum \u015fi concentra\u0163ia acestor substan\u0163e din sedimente \u015fi biot\u0103, dup\u0103 caz.<br \/>\n(3)Perioada de referin\u0163\u0103 pentru estimarea concentra\u0163iilor de substan\u0163e \u00eenregistrate \u00een inventarul prev\u0103zut la alin. (1) este fixat\u0103 la un an, urm\u0103torul inventar fiind cel care ia \u00een considerare anul 2016, urmat apoi de inventare periodice care iau \u00een considerare oricare an din fiecare interval de 3 ani ulteriori. (1), eviden\u0163iaz\u0103 dac\u0103 m\u0103surile stabilite de prevederile art. 21 alin. (1) lit. a)-d) din Legea nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, pentru stoparea sau eliminarea treptat\u0103 a evacu\u0103rilor, emisiilor \u015fi pierderilor de substan\u0163e prioritar periculoase care sunt aplicate la nivel na\u0163ional sunt suficiente \u015fi aplic\u0103 m\u0103surile suplimentare relevante stabilite la nivel comunitar pentru atingerea acestui obiectiv, dup\u0103 stabilirea acestora.<br \/>\n(3)Dac\u0103 analiza rezultatelor raportului, transmis Comisiei \u00een conformitate cu prevederile alin. LOQ).<br \/>\n6.Prevederile pct. 2 nu se aplic\u0103 pozi\u0163iilor care corespund sumelor totale ale unui grup dat de substan\u0163e sau a sumelor totale ale unor parametri fizico-chimici sau chimici \u015fi care includ metaboli\u0163i, produ\u015fi de degradare \u015fi de reac\u0163ie corespunz\u0103tori ai acestora. \u00cen aceste cazuri, rezultatele inferioare limitei de cuantificare a substan\u0163elor individuale sunt egale cu \u201c0\u201d.<br \/>\n7.Laboratoarele sau p\u0103r\u0163ile contractate de laboratoare aplic\u0103 practicile sistemului de management al calit\u0103\u0163ii, \u00een conformitate cu prevederile SR EN ISO\/IEC 17025:2007 privind cerin\u0163e generale pentru competen\u0163a laboratoarelor de \u00eencerc\u0103ri \u015fi etalon\u0103ri sau alte standarde care stabilesc cerin\u0163ele de competen\u0163\u0103 ale laboratoarelor de \u00eencerc\u0103ri echivalente acceptate la nivel european sau interna\u0163ional, stabilite de organismul na\u0163ional de acreditare.<br \/>\n8.Laboratoarele sau p\u0103r\u0163ile contractate de laboratoare \u00ee\u015fi demonstreaz\u0103 competen\u0163ele analiz\u00e2nd substan\u0163e sau parametri fizico-chimici sau chimici prin:<br \/>\na)participarea la programe de testare a competen\u0163ei; aceste programe acoper\u0103 metodele de analiz\u0103 prev\u0103zute la pct. 1 pentru oricare dintre substan\u0163ele sau parametrii fizico-chimici sau chimici pentru care efectueaz\u0103 analize, la nivele de concentra\u0163ii reprezentative ale programelor de monitorizare chimic\u0103, \u00een temeiul Legii nr. 107\/1996, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<br \/>\nb)analiza materialelor de referin\u0163\u0103 disponibile, care sunt reprezentative pentru probele recoltate con\u0163in\u00e2nd nivele de concentra\u0163ii adecvate criteriilor minime de performan\u0163\u0103 men\u0163ionate la pct. 2, aplicabile standardelor de calitate a mediului.<br \/>\n9.Programele de testare a competen\u0163ei prev\u0103zute la pct. 8 lit. a) sunt organizate de organisme acreditate ori recunoscute interna\u0163ional sau na\u0163ional, care \u00eendeplinesc cerin\u0163ele ghidului actualizat SR EN ISO\/CEI 17043:2010 (fost SR ISO\/IEC 43-1:1997) referitor la evaluarea conformit\u0103\u0163ii, cerin\u0163e generale pentru \u00eencerc\u0103rile de competen\u0163\u0103 sau ale altor standarde echivalente de evaluare a conformit\u0103\u0163ii, acceptate la nivel european sau interna\u0163ional.
